Terms and Conditions

These Standard Terms and Conditions (“Terms”), along with the applicable Work Order, constitute the SERVICE AGREEMENT (“Agreement”) between USA JUNK RELIEF (“Company”) and the “Customer,” whose details are outlined in the signed Work Order.

Junk Removal Services

The Company agrees to collect and remove from the Customer’s home, office, or other designated location (“Premises”) the items (“Customer Materials”) specified in the Work Order (hereinafter the “Services”).

What Information is Collected?

We collect both personally identifiable information (such as your name and contact details) and non-personally-identifying information (such as browser type, referring site, and access times). This helps us understand how visitors interact with our website and improve user experience. Occasionally, we may share aggregated, non-personal data with business partners for analytical purposes.

Prohibited Materials

Customer Materials must not include items that would violate any law or regulation, including but not limited to hazardous materials, waste disposal, and other environmental restrictions (“Prohibited Materials”). Hazardous Materials include but are not limited to toxic chemicals, gases, liquids, and substances regulated by local, state, or federal laws.

Ownership and Disposal of Customer Materials

Customer represents and warrants that they own or have secured the legal right to transfer ownership of Customer Materials to the Company. Upon signing the Work Order, all legal right, title, and interest in Customer Materials transfer to the Company, which may dispose of them at its discretion.

Right to Enter and Access

Customer represents and warrants that they have the authority to grant the Company unrestricted access to the Premises. The Customer assumes all risks for any damage resulting from the Company’s entry onto designated areas and holds the Company harmless for such damages.

Cancellations & Deposits

Appointments require at least 24 hours’ notice for standard cancellations or changes. For larger projects (3+ hours), 7 days’ notice is required. The Company reserves the right to collect a non-refundable deposit (10-50%) for extended projects, which will be discussed at booking. Customers remain responsible for outstanding balances if the job is completed.

Payment

Payment is due immediately upon job completion unless prior credit arrangements have been approved. Unpaid balances may be subject to collection efforts.

Disposal of Items

The Company will dispose of items in the most appropriate manner. While efforts are made to recycle and donate, circumstances may prevent it, including:

  • Refusal by donation or recycling centers

  • Poor item condition

  • Contamination (e.g., bed bugs, pests)

  • Acts of God (e.g., severe weather)

Estimates

Estimates provided before service are based on Customer-provided information. Final costs are determined on-site based on the volume of materials removed and any special disposal requirements.

Exemption from Liability

Except in cases of gross negligence or willful misconduct, the Company is not liable for:

  • Damage to or loss of Customer’s property during removal.

  • Injuries or death occurring on the Premises, including to guests or invitees.

  • Any claim exceeding the actual damage incurred.

Default & Remedies

If the Customer fails to pay or comply with any terms, the Company may pursue legal remedies, including collection efforts. All collection costs, including attorney’s fees, will be charged to the Customer.

Release of Customer Information

The Company may release Customer information as required by law or at the request of law enforcement or government agencies.

Indemnification

Customer agrees to indemnify and hold harmless the Company from any claims related to the removal of Customer Materials, except in cases of gross negligence or willful misconduct.

General Provisions

  • Governing Law & Jurisdiction: This Agreement is governed by the laws of the state in which the Company operates. All disputes shall be resolved in courts located within that jurisdiction. The Customer waives the right to a jury trial.

  • Non-Waiver: Failure to enforce any provision does not waive future enforcement rights.

  • Force Majeure: The Company is not liable for service delays caused by events beyond its control (e.g., natural disasters, labor strikes, government actions).

  • Succession: These Terms bind and benefit the parties’ successors and assigns.

  • Entire Agreement: This Agreement supersedes all prior agreements and representations.
